Vulcan Golf, LLC filed a putative class action lawsuit against Google, Inc. and other defendants, including Oversee.net, Sedo LLC, Dotster, Inc. a/k/a revenuedirect.com. The Defendants sought to have the case thrown out on a motion to dismiss. Instead, the Court allowed much of the case to proceed and ordered the parties to brief whether the case should proceed as a class action lawsuit. Vulcan Golf, LLC v. Google Inc., 2008 WL 818346 (N. D. ILL., March 20, 2008) A copy of the judge’s ruling is available here.
If the case is certified as a class action, the defendant’s potential exposure in this case could be very substantial. The plaintiffs are represented by a number of law firms, including well-respected Chicago attorney Bill Harte. (Harte is a well-known Chicago lawyer who has represented clients such as Muhammad Ali, top nationwide law firms such as Winston & Strawn, and has been involved in many high-profile cases).
