Lufthansa AG wins LH.COM

As widely reported by now, FMA has lost LH.Com in a NAF ruling.

While many think this is a disgrace (which I tend to agree), this decision, because it involves FMA, is not the worst thing that could have happened.

FMA is operated by Thunayan Al-Ghanim. For those who don’t know, Thunayan is no ordinary domainer. While FMA holds a great portfolio of generic domain names which includes i.net, multimedia.com, research.com, fm.com, and party.com (amongst many others), as Thunayan comes from one of the world’s wealthiest families, domains there seems to be more of a hobby than a business. If there is one person who can stand up to Corporate America, Lufthansa did a great job finding him.

Deutsche Lufthansa AGAlthough LH is Lufthansa’s airline code, I don’t see why Deutsche Lufthansa AG was granted the right to use the highly valuable two-letter domain LH.COM. This is an acronym domain which can stand for many other meanings, it does not infringe on Lufthansa’s trademark. I wish Thunayan Al-Ghanim (FMA) good luck with fighting the NAF ruling!

Some great domain auctions

There are some high-value domains for sale in auctions right now that should result in great sales next week.

For example, Sedo/GreatDomains is currently running an auction for Bond.com. Bidding is currently at $66,666 with more than 4 days left; the reserve has not yet been met. Not only might this domain get type-ins every time a new James Bond movie comes out (it would be foolish to feature James Bond content or ads under this domain, though), but this domain is extremely valuable due to its meaning in finance.

Another interesting Sedo auction is XP.com. Bidding on this two-letter domain with content is at $499,000 and the reserve on this one has not been met, either. According to Sedo it is in the $500,000 to $1,000,000 range, so it’s possible the next bid will push it above the minimum.

If you like red wine you might also like Chianti.com. This domain can be bought at Sedo, too, with a current bid of $5,100. Then Sedo/GreatDomains has a bunch of other domains where bidding is still below the name’s value, in my opinion: ProGolfers.com ($70), Pizzerias.com ($1,050), Sold.co.uk (£2,500), Postal.com ($20,000), Whiskey.net ($6,000), OMA.com (€11,000; not only a three-letter domain, but “Oma” is also German for Grandma), Directories.com ($800) and many more.

Over at TDNAM, another top-notch domain is waiting for willing buyers: Villas.com. Bidding is currently at $28,000, needless to say that the reserve has not yet been exceeded. This domain has been on the market for some time now. It was previously marketed together with other top domains such as Villas.eu, Villas.info, Villas.mobi and Villas.es as well as variations of the name, potential magazine titles and related intellectual property. I was one of the brokers who promoted this high-value portfolio at that time, but no buyer was found (back then, the owner was looking for offers in the neighborhood of $5 million). Now that Villas.com is for sale as-is (the Villas.com trademark is included in the sale, though), it will be interesting to observe the auction to see how high bidding will go and whether it will reach the minimum price. Although I don’t know any details about the TDNAM auction, I guess the reserve should be somewhere in the $500K-$1M range. The domain is definitely worth much more than that.

And for those looking for German domains, Sedo has some for sale with low bids at the moment: neidlos.de (€100), InternetFlatRate.de (€300), Knackarsch.de (€1,200), Sachgebiet.de (€65) and Routenplaner.com (€99).

DomainTools also has some auctions raring to go: The DomainTools Live Auction held at the Domain Roundtable Conference in San Francisco will begin tomorrow. Online bidding is open already. Domains for sale include SanFranciscoBayArea.com, Invites.com, FG.com, ProductLawyer.com, Smash.com, DomainNameTransfer.com, Renewals.com, Motorsports.com, Retire.net, Keyword.net, ParkStreet.com, RetirementInvestments.com and several others. Most domains do not have bids, yet.

Facilitate innovation

Innovation is what drives businesses and, as a result of that, economies and lifestyle. Therefore, it is very important to create environments that facilitate innovation, be it within your business, in school or universities.

SSE VenturesStanford has recently launched an early stage venture fund called SSE Ventures (Stanford Student Enterprises). It is a student association with $13 million in assets and several hundred employees trying to help the university’s undergraduate and graduate students start innovative companies. Stanford is the place where Sun, Yahoo, Google and other technology companies found their start. Now, Stanford is about to get even more student projects and businesses off the ground. SSE Ventures will invest $50,000 to $100,000 per project, according to the fund’s website.

Although some argue that Stanford wants to fill its pockets (the university takes a share in the companies it funds), I strongly believe that programs such as SSE Ventures facilitate innovation. Continue reading ‘Facilitate innovation’

Cern works on superfast Internet

THE internet could soon be made obsolete. The scientists who pioneered it have now built a lightning-fast replacement capable of downloading entire feature films within seconds.

At speeds about 10,000 times faster than a typical broadband connection, “the grid” will be able to send the entire Rolling Stones back catalogue from Britain to Japan in less than two seconds.

The latest spin-off from Cern, the particle physics centre that created the web, the grid could also provide the kind of power needed to transmit holographic images; allow instant online gaming with hundreds of thousands of players; and offer high-definition video telephony for the price of a local call.

Court refuses to dismiss claims alleging Google’s participation in “scheme to use deceptive domain names”

Vulcan Golf, LLC filed a putative class action lawsuit against Google, Inc. and other defendants, including Oversee.net, Sedo LLC, Dotster, Inc. a/k/a revenuedirect.com. The Defendants sought to have the case thrown out on a motion to dismiss. Instead, the Court allowed much of the case to proceed and ordered the parties to brief whether the case should proceed as a class action lawsuit. Vulcan Golf, LLC v. Google Inc., 2008 WL 818346 (N. D. ILL., March 20, 2008) A copy of the judge’s ruling is available here.

If the case is certified as a class action, the defendant’s potential exposure in this case could be very substantial. The plaintiffs are represented by a number of law firms, including well-respected Chicago attorney Bill Harte. (Harte is a well-known Chicago lawyer who has represented clients such as Muhammad Ali, top nationwide law firms such as Winston & Strawn, and has been involved in many high-profile cases).

Microsoft sets ultimatum

Microsoft has sent an open letter with a written ultimatum to Yahoo’s Board of Directors. In the letter Steve Ballmer, CEO of Microsoft, says Yahoo should either conclude an agreement to be acquired by Microsoft within the next three weeks or they will take their case directly to Yahoo’s shareholders and initiate a proxy fight.

Although Ballmer clearly states that Microsoft doesn’t want to raise its bid for the search company, I can’t believe that they would just walk away from Yahoo. Continue reading ‘Microsoft sets ultimatum’

Pizza.com sold for $2.6 million

Today Sedo successfully brokered the sale of Pizza.com for $2.6 million. I do not yet know who the buyer is, but I hope that it is an end user, because that is what our industry needs most: more corporate buyers.

Pizza.com has great value for big companies such as Pizza Hut: It is a generic domain with inarguably lots of type-in traffic and branding and marketing potential (it would make a great URL in TV ads).

By the way, inspired by this domain’s sale price Pizza.info has now been put up for sale at Sedo as well. Bidding is currently at $1,050.
